Rule 8
Compensation to be given

(1) For the purpose of section 15 of the Act, the compensation to be given by the person or organization producing such medicine to a person whose health has been harmed by the consumption of any medicine or if such person dies, shall be as follows:-

(a) Heart, Liver, Brain, Kidney (Both) Lung
(Both) In case of damage and loss, for each - three lakh
(b) If only one kidney or only one lung is damaged or becomes useless – one lakh
for each. (c) If the following organs are damaged or become useless –

(1) For both eyes – two hundred and fifty thousand
(2) For both ears – two lakh
(3) For nose – one lakh
(4) For the tongue – one hundred and fifty thousand
(5) For Ling – one hundred and fifty thousand
(6) For one eye – one lakh
(7) For one ear – seventy thousand
(8) For both hands or both legs – two hundred and twenty thousand
(9) For an arm or a leg or a part of an arm or a leg – eighty thousand
(10) For a part of both hands or a part of both legs – eighty thousand
(11) For each finger or toe – Five thousand

(d) If any internal organ other than the organs covered in clauses (a), (b) and (c) is damaged or becomes useless – One lakh
(e) In case any external parts other than the parts included in clauses (a), (b) and (c) are damaged or become useless – eighty thousand
(f) If any part is damaged without being functional, compensation will be given up to two-thirds of the amount of compensation given in case of non-functionality.
(g) In case of miscarriage before twenty-eight weeks - ten thousand rupees
(h) In case of miscarriage of twenty-eight weeks or more - twenty-five thousand rupees (j) In case of birth of a child due to damage to the womb due to the damage of the organs - Fifteen thousand rupees
(j) In case of death of a person – thirty thousand rupees.

(2) Notwithstanding anything written in sub-rule (1), the amount of compensation to be given in accordance with this rule shall not exceed 3,00,000 (three lakh) rupees. No.
